ANNOUNCING NICK BRESTOFF, ESQ., "OF COUNSEL"

 

            The firm is pleased to announce that Nick Brestoff is now serving as "of counsel" on litigation matters. Nick's education includes engineering degrees from UCLA and Caltech, and a law degree from USC, where he was a member of the Law Review.  More importantly, Nick has 35 years experience in state and federal court business litigation, including a $10.1 million recovery after a successful federal court jury trial and successful Ninth Circuit appellate proceedings.  Nick is also a nationally known author, teacher, and "thought leader" in the discovery of electronically stored  information ("e-Discovery"). In the past twelve months, his articles have been published by the ABA E-Discovery & Digital Evidence Journal, Law Technology News, and the Journal of the Consumer Attorneys Associations for Southern California.  He also holds an A-V rating by Martindale Hubbell, the highest ratings for competence and ethics.

  

Most recently Nick was quoted and featured in the April 2011 issue of the ABA  Journal's cover story, "As Bulging Client Data Heads for the Cloud, Law Firms Ready for a Storm." 

  

Given the rising importance of e-Discovery issues in litigation, both for document production to opposing counsel, and for document requests from opposing counsel, Nick's experience places the firm in excellent position to handle any intellectual property (IP) litigation.  The firm is currently working on various  IP litigation matters, including a patent infringement defense, and defense against a false patent marking claim. Nick's experience has already made a difference in these cases.

As soon as litigation is reasonably anticipated, the law places a burden on your company or you to preserve your evidence that relates to the case.  Normal backups can delete key evidence and result in substantial sanctions (penalties) in litigation.  Make sure information preservation is handled carefully.
